Terms of Service

1. Acceptance of Terms
By creating an account, launching a campaign, or making a donation on Reciva ("the Platform", "we", "us"), operated by Precious Mawaya, trading as Reciva, you agree to these Terms of Service. If you do not agree, please do not use the Platform.
2. What Reciva Does
Reciva lets individuals create fundraising campaigns and receive support from donors via Malawi Kwacha (MK) donations, processed through our payment partner PayChangu. We do not guarantee that any campaign will reach its goal.
3. Eligibility
You must be at least 18 years old, or have permission from a parent/legal guardian, and provide accurate information when registering. You are responsible for keeping your account credentials secure.
4. Campaigns & Donations
Campaign creators are solely responsible for the accuracy of the information in their campaigns. Donations are voluntary contributions to the campaign creator, not to Reciva. Donors should exercise their own judgment before donating; Reciva does not verify every campaign's claims.
5. Fees
The fee model depends on how a donation is made. For donations via mobile money checkout, the donor's total includes a small processing surcharge that covers PayChangu's fee, so the campaign creator's available balance is credited the full amount they set out to donate - no cut is taken at donation time. For donations via bank transfer, the donor sends the exact amount they chose with no surcharge; instead, PayChangu's processing fee and Reciva's platform margin are deducted from what is credited to the creator's balance. In both cases, when a creator withdraws funds, PayChangu's payout processing fee (currently 3%) and Reciva's system fee (currently 2%, where applicable and not waived) are deducted from the requested withdrawal amount. The exact amount you'll receive is always shown before you confirm a withdrawal.
6. Withdrawals
Withdrawal requests are processed to the payout method you provide. Processing times depend on PayChangu and may vary. Reciva is not liable for delays caused by payment providers or banks.
7. Prohibited Uses
You may not use the Platform for fraudulent campaigns, money laundering, illegal fundraising, or to solicit funds for prohibited purposes under Malawian law. We reserve the right to suspend or remove any campaign or account that violates these terms.
8. Account Termination
We may suspend or terminate accounts that violate these Terms, engage in fraud, or pose risk to other users. You may close your account at any time by contacting support.
9. Disclaimers & Limitation of Liability
The Platform is provided "as is". Reciva is not responsible for the conduct of campaign creators or donors, or for the ultimate use of donated funds. To the maximum extent permitted by law, Reciva's liability is limited to the fees we've collected from the transaction in question.
10. Governing Law
These Terms are governed by the laws of the Republic of Malawi. Any disputes will be resolved in the courts of Malawi.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
